Right of Withdrawal

Scope: This right of withdrawal applies to consumers (§ 13 BGB) habitually resident in the EU who subscribe to a paid plan on the Scanara platform. Customers acting as entrepreneurs within the meaning of § 14 BGB have no statutory right of withdrawal (see § 1 of the Terms of Service). Customers habitually resident outside the EU have no EU withdrawal right under §§ 312g, 355 BGB; the consumer protection law of their country of residence may apply.
Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement (e.g. an email). You may use the attached model withdrawal form, but it is not obligatory. You may also declare the withdrawal via the withdrawal function ("Vertrag widerrufen" button) in the account settings of the platform (app.scanara.io → Settings → Billing).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Proportional Compensation for Services Already Rendered
If you requested that performance of services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
No compensation is due for the free 14-day trial period, provided you withdraw before a paid billing period has commenced.
Proportional compensation is calculated on a daily rate basis (monthly or annual price divided by the number of calendar days in the billing period, multiplied by the number of days of use until withdrawal).
Expiry of the Right of Withdrawal
The right of withdrawal expires when the Provider has completely performed the service and began performance of the contract only after the Customer has
- given prior express consent to the Provider beginning performance before the withdrawal period has expired, and
- acknowledged that they will lose their right of withdrawal upon complete performance of the contract by the Provider.
This follows from § 356 para. 4 German Civil Code (BGB) (services, including digital services) / Art. 16(a) Consumer Rights Directive 2011/83/EU.
For Scanara this means: for a running subscription, the service is generally not yet completely performed within the 14-day withdrawal period. Your right of withdrawal therefore continues during the 14-day period even if you are already actively using the service. In the event of withdrawal, however, you owe pro-rata compensation for services rendered up to the withdrawal (§ 357a para. 2 BGB), provided you expressly requested at checkout that performance begin before the withdrawal period expires and we duly informed you about your right of withdrawal and the compensation obligation.
Important: The acknowledgement of the loss of the right of withdrawal is not bundled with acceptance of our Terms of Service. It requires a separate, explicit declaration — presented to you individually at checkout.
§ 356a BGB — Withdrawal Button (from 19 June 2026)
From 19 June 2026, § 356a BGB requires a permanently accessible withdrawal function ("Vertrag widerrufen" button) for consumer distance contracts concluded via an online interface. Non-compliance automatically extends the withdrawal period to 12 months and 14 days. The withdrawal function is available on the Scanara platform in the account settings (app.scanara.io → Settings → Billing).
[!NOTE] needs-lawyer-confirmation: The model withdrawal notice (EGBGB Annex 1) must be reviewed and updated to reflect § 356a BGB. Legal review required before go-live. Additionally confirm: the "Expiry of the Right of Withdrawal" section was corrected on 12 June 2026 — for services, expiry requires complete performance (§ 356 para. 4 BGB); for running subscriptions, the right does not expire merely upon first use.
Open items from internal audit of 12 June 2026 (for legal review):
- Verify sanction citation: the extension to 12 months + 14 days likely follows from the amended § 356 para. 3 BGB, not "§ 356a para. 4 BGB" (paras. 3–4 govern the receipt confirmation).
- Resolved (12 June 2026): telephone number added to the notice (design note 2 of Annex 1 EGBGB, ECJ C-266/19). During legal review, confirm the published website copy also includes the telephone number.
- Compensation precondition: § 357a para. 2 no. 1 BGB requires the consumer's express "request" (Verlangen), not mere consent — adjust checkout wording. Tying compensation to the two § 356 para. 4 declarations (section above) is legally imprecise.
- § 356a withdrawal function: must the button be reachable without login (contract is concluded via the website)?
- Narrow the scope statement: § 356a applies to distance contracts concluded via an online interface, not to "all" distance contracts.

Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
